House Rules
Check-In/Check-Out Times. Check-in begins at 4:00pm(CST) on arrival date. Check-out time is 10:00AM (CST) on departure date. No early check-in or late checkouts allowed unless previously arranged with the owner. Refunds are not given for late arrivals or early departures.
Advance Payment. An advance payment equal to 50% of the total booking charges is due at the time of reservation. This advance payment will be applied towards the total booking charges due. If the reservation is booked through VRBO or Airbnb, 100% of the total booking charges is due at the time of booking.
Rent Payment. Please provide payment directly to one of the owners or via the online payment system if making a booking online. The final balance (second payment) of the total rental charges are due 60 days prior to your arrival date. If the reservation was booked through VRBO or Airbnb, 100% of the total booking charges is due at the time of booking.
Cancellations and Changes. Reservations may be canceled by notifying the owner in writing at sixty (60) calendar days prior to your check-In date. If you need to cancel for any reason after receipt of your reservation, you will receive 100% of your money back if it is outside of 60 days of the start of your rental. If it is within the 60 days of the start of your rental but outside 30 days, you will forfeit the deposit and the first half of your rental payment. If the cancellation is within 30 days of the start date of your rental, you will receive no refund on your rental fees.
Pet Policy. Pets are not allowed in the rental home or on the property under any circumstances. Guests who violate this policy by bringing a pet will be charged an additional $500, plus the expense of any necessary cleaning. Violations may also result in immediate eviction and forfeiture of rent.
No Smoking. Smoking is not permitted at any tie in the rental property or on the premises of the property. Guests who violate this policy will be charged an additional $2000, plus the expense of any necessary cleaning. Violations will also result in immediate eviction and forfeiture of rent.
Maximum Occupancy. The maximum occupancy of the rental home is 10 people. The number of guests per accommodation is based on the individual accommodation’s ability to comfortably and safely house our guests. If the maximum occupancy is exceeded, you may be asked to vacate the property and forfeit any rental payments.
Parking. Parking is limited to THREE vehicles. (two in the gravel directly in front of the home and one in the driveway). No trucks, buses, boats, trailers or recreational vehicles may be parked within Tannin. Not included in the category of “trucks” are SUVs, small personal pickup trucks up to a “half ton” in size and mini vans provided these vehicles are clearly for personal, non-commercial use and do not have oversized tires, dual tires, material racks or tanks external air conditioning units or similar modifications or additions. No vehicle which displays advertising or the name of a business may be parked overnight in Tannin. The Village of Tannin is a pedestrian community which requires particular care when driving and parking. Park only on the gravel areas to be sure tires do not overhang into the brick area of the street. This is to maintain the required twenty foot access for emergency vehicles. If a fine is incurred due to any of the aforementioned, the fine amount will be deducted from the guests’ damage deposit.
Garbage. Garbage pick-ups for the city are on Tuesdays and Fridays. Please be sure your trash bags are outside in the can by these days. You do not have to take the cans to the street. We have a trash service that will pull the cans to the road for trash pick-up and return them to the rear of the home after trash is picked up for your convenience. Please notify the owner if cans are not where they should be.
Age Requirements. This property is for family rental use only. No units will be rented to vacationing students or young adults under the age of 25 unaccompanied by a responsible parent or guardian at a ratio of five (5) young adults to one (1) adult over the age of 25. The person signing this rental agreement must stay at the rental home through the duration of the rental period. Guests who violate this policy will be immediately evicted and forfeit all rental payments.
Spring Break/Fall Break. For reservations in March or April, it is required that one parent or guardian over the age of 25 is present and staying in the property for every three (3) guests between the ages of 15 and 25. Proof of age is required by all guests and all homes are subject to inspection upon guest arrival and during guest stay to ensure compliance. Age may be verified by copies of a valid Driver’s License, Driver’s Permit or birth certificate, and guests agree to provide the owner with such identification. Violations will result in immediate eviction and forfeiture of all the total booking charges.
Falsified Reservations. Reservations made under false pretense are null and void and check-in will not be allowed or guests will be asked to vacate the accommodations. This policy includes reservations made by parents or guardians who do not check in, and/or leave overnight during the length of the stay. Any reservation obtained under false pretense will forfeit total booking charges.
Housekeeping. All stays will be subject to a cleaning fee. Your vacation accommodations will be cleaned to our highest quality standards prior to your arrival and after your departure. If the premises are dirty or damaged upon check-in, you are responsible for notifying the owner immediately to avoid loss of deposit refund (if you paid one). You will be responsible for the cleaning of your unit during your stay and for leaving the unit in good condition at check-out. We respectfully request that you remember that you are staying in someone’s home during your vacation; please treat it with the care you would your own. If property is found abnormally dirty at check-out, you will be responsible for additional charges to cover the cost of performing a deep cleaning of the unit.
Beach & Pool Towels. As a service to you, we provide beach/pool towels for your use at the pool and beach. We do not permit the white bath towels or lines to be taken from the property. To allow us to be able to provide this service to our future guests, please be responsible with these towels and be sure to wash, dry, and fold these towels and place them in the laundry basket in the laundry room upon checkout. The cleaning fee covers the washing of all other linens in the house, but does not cover the cost of cleaning the pool/beach towels.
Maintenance. During your stay, promptly report any maintenance problems to the owners. No required refund or rate adjustment will be made for unforeseen failures, such as, but not limited to, the supply of electricity, water, pool systems, air conditioning, telephone, television or cable service, appliances, wi-fi access, etc.
Grill and Propane Tanks. Guests are to use the grill responsibly and ensure it is turned off, cleaned properly, and covered after each use. Owners are not held liable for any injuries related to guests' use of the grill. Should a propane tank for a grill become empty during a guest’s stay, please call the owners and we will make arrangements for it to be changed out for you. At any time during business hours or after hours, the guest has the option to exchange the tak themselves at their own risk. The owners are not liable for loss of food products due to propane running out during cooking.
Damage Policy. Guests are responsible for the property, its contents, and themselves during occupancy. Guests must lock windows and doors securely when not in the premises. Rearranging the furniture or removing any items for the unit is prohibited. After Check-out, the property will be inspected for damage, rearranged furniture, missing items, and abnormally dirty appearance. If the owner determines that damage has occurred, items are missing, or the unit is abnormally dirty, the owner will repair damage, replace the missing items, and/or perform a deep clean of the unit at the renter’s expense
Hurricanes and Severe Weather. Refunds for cancellations or shortened stays due to actual or anticipated hurricanes, tropical storms, other inclement weather or Acts of God will not be issued by owners under any circumstances.
Nearby Construction. There may be construction ongoing at properties adjacent to or close by the property being rented by a guest. The rules regarding acceptable noise levels, start and finishing times, and other restrictions relating to any such constructions are governed by local ordinances and/or community specific rules and regulations beyond the control of the owner. As such, guests shall not be entitled to a refund relating to such construction. Notwithstanding this, the owner will use its best efforts to ensure that the appropriate parties are notified and appropriate remedial action taken in the event that it receives notice that the construction at issue may be in violation of any such regulations or ordinances.
Neighborhood Rules Tannin. Only those tenants residing in the house may use The Common grounds of Tannin. Neighborhood rules are posted in the home and are available per request of guests. Rules have been established for the pool, which must be followed. Catch and release fishing only in the lakes. Do not feed or annoy any alligator. Association has the authority to assess the homeowner fines of $50 per violation plus $10 additional per day for violation of the rules. Such fines will be deducted from the Guest’s deposit.
Security of Property. The owner(s) are not responsible for any acts of theft or vandalism, or other damages to any personal property or for personal items left by guests in the house at departure. The premises are equipped with exterior security cameras. Cameras are not monitored for guests safety in any way and should not be relied on by guests for personal security or security of their belongings. Cameras may be used to enforce and verify compliance with rental policies. Any tampering or intentional damage caused to the cameras by guests will result in replacement at renters’ expense.
Damage. There will be some instances where a $500 refundable damage deposit is paid at time of booking on this property (excludes bookings made on seral rental websites (VRBO, etc.) which do not require this to be paid up front). For those who have paid a damage deposit at time of booking, it is refundable approximately 2-3 days after departure as soon as the house and linens have been inspected for damage and cleanliness and as long as the following provisions are met: No damage is done to the property or it’s contents, beyond normal wear and tear. No linens, household items, decor, etc. are missing or damaged; Guest(s) did not incur any charges due to contraband, pets, or collection of rents or services rendered during the stay; no excessive cleaning is required, and all house keys, all pool bands, beach towels, and beach equipment are left in the designated location. The unit windows and doors are left locked. Additional monies will be collected for repair of damaged or missing items if the amount of damage exceeds the $500 damage deposit. For those who have not paid a damage deposit up front, but should any damage occur, the renter will be responsible for the entire replacement cost.
No Subletting. The rental property may not be sublet. Your reservation is not transferable to any other party.
Property Rules and Regulations. Please observe all rules and regulations governing the use of the property and neighborhood you are occupying. These rules apply to both owners and guests, and failure to comply will result in eviction and forfeit of all booking charges.
Applicable Law. This Agreement shall be governed by, construed under, and enforced and interpreted in accordance with the laws of the State of Alabama, excluding its principles of conflicts of laws.
Venue, Jurisdiction, and Attorneys’ Fees. The exclusive venue for any civil action related to this Agreement is Baldwin County, Alabama. The parties hereby submit to the personal jurisdiction of all the proceeding to enforce or interpret the terms of the Agreement or to collect any amount due hereunder, the prevailing party shall be entitled to reimbursement for all costs and expenses reasonably incurred in enforcing, defending or interpreting its rights hereunder, including, but not limited to, all attorneys’ fees and the costs expended in determining entitlement to and amount of such fees.
Waiver of Jury Trial. BY ENTERING INTO THIS AGREEMENT, THE PARTIES KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A JURY TRIAL AS TO ANY CLAIMS A PARTY MAY CLAIM TO HAVE AGAINST THE OTHER WHICH ARISES OUT OF THIS AGREEMENT OR THE COURSE OF DEALINGS BETWEEN THE PARTIES.
Force Majeure. Notwithstanding any other provision of the Agreement, no party to the Agreement shall be deemed in default or breach of the Agreement or liable for any loss or damages or for any delay or failure in performance (except for the payment of money) due to any cause beyond the reasonable control of, and without fault or negligence by such party.
Entire Agreement. This Agreement constitutes the entire agreement between the parties and supersedes any prior understanding, marking or agreement among them respecting the subject matter hereof. There are no representations, arrangement, understandings or agreements, oral or written, relating to the subject matter of this Agreement, except those fully expressed herein. No waiver of any provision hereof shall be valid or binding on the parties hereto, unless such waiver is in writing and signed by or on behalf of the parties hereto, and no waiver on one occasion shall be deemed to be a waiver of the same or any other provision hereof in the future.
Indemnification of Owner. Guest will defend, indemnify and hold owner(s), harmless from any and all claims, liabilities, losses, costs and expenses (including, but not limited to, reasonable attorneys’ fees and costs of suit) incurred by owners as a result of or arising out of breach of this Agreement guest, except to the extent such claims, demands and actions arise from the negligence or willful misconduct of owners. The indemnified party shall promptly notify the indemnifying party of any such claim and shall, at the request and expense of the indemnifying party, cooperate in the investigation and defense of such claim.
Release of Liability, Waiver of Claims, Express Assumption of Risk and Indemnity Agreement. Owner makes all attempts to maintain the vacation rental property. The guests agree to immediately notify the owner of any maintenance problems, so that the situation can be remedied as soon as possible. The owner(s) shall not be held liable for any injuries that may occur to guest(s) while on the premises, as a result of using the property, bicycles, or actions of the guests. Owner is not responsible for any inconveniences that may occur for which he/she has no control. This includes mandatory evacuation, construction, mechanical failure such as the community pool or television, etc. No refunds will be given for occurrences beyond the owner’s control.
In consideration for receiving access and/or permission to use any amenities, including but not limited to bikes, swimming pool, beach equipment at your rental Property or otherwise made available to you as an amenity in conjunction with your rental of this property. You hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS for any and all purposes, Owners, and their respective affiliates, officers, servants, agents, volunteers, or employees (herein collectively referred to as RELEASES) FROM ANY AND ALL LIABILITIES, RESPONSIBILITIES, CLAIMS, DEMANDS, CAUSES OF ACTION OR INJURY, INCLUDING DEATH, that may be sustained by you or your guests or invitees while participating in such ACTIVITY, whether cause by RELEASEES’ active or passive negligence.
You agree that you are fully aware that there are inherent risks involved with ACTIVITY, including, but not limited to, possible physical injury (including, but not limited to, broken bones, strains, sprains, bruises, concussions, heart attack, heat exhaustion) and loss of life, and you choose to voluntarily participate in said ACTIVITY with full knowledge that said ACTIVITY may be hazardous to you, your guests, your invitees, and your property (“You”). YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISK OF LOSS, PROPERTY DAMAGE OR PERSONAL OR EMOTIONAL INJURY, INCLUDING DEATH, that may be sustained by you as a result of participation gin said ACTIVITY, whether supervised or unsupervised. You further agree to indemnify and hold harmless the RELEASEES for any loss, liability, judgment, settlement, damage or costs, including court costs and attorney’s fees for both the trial and appellate levels that may occur as a result of or in any way related to your participation in said ACTIVITY, whether caused by RELEASEES’ active or passive negligence or otherwise.
You understand that RELEASEES may not maintain any insurance policy covering any circumstance arising from your participation in this ACTIVITY or event related to that participation. As such, you are aware that you should review your personal insurance coverage.
You hereby certify that you are at least 18 years of age and you are legally competent to enter into this Agreement, including the Release, Waiver, Assumption and Indemnity provisions contained herein. HYou agree that it is your express intent that this release shall bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representatives, if you are deceased, and shall be governed by the laws of the State of Alabama.
Severability. If any term or provision of the Agreement is held illegal, invalid or unenforceable, such illegality, invalidity or unenforceability shall not affect the legality, validity or enforceability of the remainder of this Agreement.
Headings. Section and other headings contained in this Agreement are for reference purposes only and are in no way intended to define, interpret, describe or limit the scope, extent or intent of this Agreement or any provision hereof.
